ARAÇ KİRALAMA SÖZLEŞMESİ
Sözleşmenin Konusu ve Süresi
1. Sözleşme, mülkiyeti Extreme Rent A Car’a ait Atv, Utv, Motorsiklet, Bisiklet sözleşmede öngörülen şartlar çerçevesinde Kiracı’ya kiralanması, Kiracı tarafından kullanılması hususunda akdedilmiştir. Sözleşme, sözleşmenin imzalanmasından itibaren …….. gün süre ile geçerli olup, bu süresinin sonunda, herhangi bir ihbara gerek olmaksızın kendiliğinden sona erecektir. Sözleşme, taraflarca ancak yazılı olarak yenilenebilecektir.
Kiracının Yükümlülükleri
(1) Kiracı, Sözleşme kapsamında kiraladığı Atv, Utv, Motorsiklet, Bisiklet ilgili olarak, kendisi ve ismini yazdırdığı kişiler dışında kimseye kullandırmayacağını taahhüt eder. Aksi takdirde, Kiracı, zarar ve ziya Kiracı tarafından tazmin edilecektir.
(2) Atv, Utv, Motorsiklet, Bisiklet, normal kullanım maksatlarının dışında eğitim, yarış, off road, ralli, vs. amaçlarla kesinlikle kullanılamaz. Aksi takdirde, Kiracı bu sebeple oluşabilecek tüm zarar ve kayıpları karşılamakla yükümlü olacaktır.
(3) Aracın kapasite ve üretim amacı dışında kullanılması, tümsek ve çukurlar gibi yol seviyesinden farklı yerlere vurması, arazide ve kumsalda kullanılması sonucu oluşacak tüm zararlar ile aracın motor veya diğer bölümlerine su girmesi sonucu oluşan hasarların sorumluluğu kiracıya aittir.
(4) Araçlara aşırı yükleme yapılamaz ve yük taşınamaz. Aksi takdirde, Kiracı bu sebeple oluşabilecek tüm zarar ve kayıpları karşılayacaktır.
(5) Atv, Utv, Motorsiklet, Bisiklet, kullanıldığı tüm süreler boyunca; kask takılması, Araçların dengesini bozacak yük ve ekler yüklenmemesi, sürücüleri tarafından alkollü halde kullanmaktan kaçınılması gibi gerekli tüm tedbirleri almak suretiyle Araçta bulunan şahıs/şahısların can ve mal emniyeti korunacaktır. Ayrıca, trafik kurallarına azami dikkat gösterilerek, üçüncü şahısların can ve mal emniyetine zarar getirebilecek her türlü davranıştan da kaçınılacaktır. Kiracı, araçta bulunan diğer şahısların can veya malında zarar ya da kayıp oluşmasına sebebiyet vermesi durumunda, bundan ötürü doğacak her türlü zarar ve kaybı münhasıran tek başına karşılamakla sorumlu olacaktır. Bu sebeple Extreme Rent A Car tarafından herhangi bir zarar üstlenilmek ya da ödeme yapılmak zorunda kalınması durumunda, Extreme Rent A Car söz konusu zararının tazmini konusunda Kiracı’ya rücu edecektir.
(6) Sözleşme’nin yürürlükte olduğu süre içerisinde Araçlara ilişkin olarak kesilen trafik cezaları ya da tahakkuk eden yol geçiş ücretlerinin tamamı, Kiracı tarafından yasal süreleri içinde ödenecektir. Buna ilişkin ödeme belgeleri Kira Sözleşmesi sona erdikten sonra Extreme Rent A Car’a bildirilse dahi, bu ödemelerden de münhasıran Kiracı sorumlu olacaktır. Bu sebeple, Extreme Rent A Car tarafından, Kiracının kullanımından kaynaklanan herhangi bir ceza, masraf ya da zarar üstlenilmek ya da diğer herhangi bir ödeme yapılmak zorunda kalınması durumunda Extreme Rent A Car’a söz konusu zararının tazmini konusunda Kiracı’ya rücu edecektir.
(7) Kiracı, aracı kullanılmadığı her durumda kilitli tutmalıdır.
(8) Kiracı,doğru ve uygun yakıt kullanıldığından emin olmalıdır.
(9) Kiracı, lastik ve havalarını olması gereken düzeyde tutmalıdır.
(10) Kiracı, araçları ve hiçbir parçasını satamaz, kiralayamaz ya da elden çıkartamaz.
(11) Kiracı, Herhangi bir kişiye araç üstünde yasal haklar tanıyamaz ve kendi haklarını devredemez. Acil durumlarda 24 saat ulaşabileceğiniz telefon numarası aracı teslim aldığınız ofis yetkilisi tarafından size verilecektir.
(12) Motosiklet içerisinde unutulan özel eşyalardan ötürü Extreme Rent A Car sorumluluk kabul etmeyecektir.
Mali Hükümler
(1) Kira Bedeli, her bir tutanakta kiralanan araçlar dikkate alınarak belirtilecektir.
(2) Kiracı, Kira Süresinin bitiminden itibaren en geç 24 saat süre içerisinde aracı ya da araçları iade etmediği takdirde, gecikilen her bir gün için günlük kira bedelinin bir katını gecikme cezası olarak Extreme Rent A Car’a ödeyecektir.
(3) Extreme Rent A Car, zorunlu mali mesuliyet sigortası teminatı kapsamı dışında kalan sorumlulukların dışında, hiçbir zarar ya da talepten sorumlu olmayacaktır.
(4) Kiracı, kullanım hatasından dolayı oluşacak, sigortaların karşılamadığı hasarların tamir bedeli ile sigorta kapsamına girmeyen hasarlardan kaynaklı aracı kiraya veremediğimiz günlerin ücretlerini,( Standart günlük kira fiyatı fiyat üzerinden ücretlendirilecektir.)ödemeyi taahhüt eder
(5) Kiracı, aracın Emniyet güçleri tarafından herhangi bir sebep için alıkonulmasından dolayı ortaya çıkabilecek zararlar ve aracı kiraya veremediğimiz günlerin ücretlerini ödemeyi taahhüt eder.
(6) Kiracı, aracı ya da araçları ilgili ofisimizin bulunduğu şehir yerleşim sınırları dışına teslim etmek ve teslim almak için ortaya çıkabilecek ücretlerden sorumludur.
Sigorta Hükümleri
(1) Araç Kiracı’ya teslim edildikten sonra herhangi bir sebeple bunlara ilişkin olarak ortaya çıkacak her türlü tür kayıp, münhasıran Kiracı tarafından karşılanacaktır. Kiracı, kendi kullanım hatalarından kaynaklanan hasar ve zararların belgelenememesi ya da zarar ve kayıpların herhangi bir sebeple sigorta teminat kapsamı dışında kalması durumunda söz konusu zarar ve kayıpların giderilmesi için gerekli olacak her türlü masrafı, bu konuda hüküm istihsaline gerek olmaksızın derhal Extreme Rent A Car’a ödemeyi kabul ve taahhüt eder.
(2) Kiracı, Kira Süresi boyunca Araçları açık otopark, yol ya da kaldırım üzeri gibi emniyetsiz yerlere park halinde ya da geçici olarak bırakamaz. Kiracı, Araç park halindeyken azami güvenlik tedbirlerini almakla ve Aracı kapalı ve güvenli bir otoparkta muhafaza etmekle yükümlüdür. Aksi takdirde Kiracı, herhangi bir sebeple Araçta meydana gelecek zarar ve kayıpların sigorta teminat kapsamı dışında kalması halinde, her türlü zararı münhasıran ödeyeceğini taahhüt etmektedir.
(3) Kiracı, Araç herhangi bir şekilde kazaya karıştığı takdirde, gerekli sigorta ve diğer işlemlerin yapılabilmesi için, alkol muayenesi raporu, kaza raporu, ehliyet fotokopisi, karşı tarafın ruhsat fotokopisi, karşı tarafın trafik sigorta poliçe fotokopisi, gibi belgeleri, kaza tarihinden itibaren en geç yedi gün içinde Extreme Rent A Car’a vereceğini taahhüt eder. Kiracı’nın kusuru olsun olmasın, bu konuda ortaya çıkacak gecikmelerden ötürü sigorta şirketinden tahsilat yapılamaması ya da diğer herhangi bir zararın oluşması durumunda, tahsil edilemeyen tutar ya da zarar münhasıran Kiracı tarafından karşılanacaktır.
(4) Kiracı, Aracın karıştığı kazalarda, zorunlu mali mesuliyet sigorta poliçesi teminatını aşan ya da söz konusu teminat kapsamı dışında kalan durumlarda, üçüncü şahıslar tarafından ileri sürülebilecek her türlü talebin karşılanması konusunda münhasıran sorumlu olacaktır. Kiracı, kazaya sebebiyet verdiği üçüncü şahıslar tarafından Extreme Rent A Car aleyhine dava ya da talep ikame edilmesi halinde, bu durum ihbar edilmemiş olsa dahi, mahkeme kararı ya da ödeme belgesinin kendisine bildirildiği tarihten itibaren en geç bir hafta içerisinde, bildirilen tutarın tamamını Extreme Rent A Car’a ödemeyi kabul ve taahhüt etmektedir. Kiracı, herhangi bir sebeple kendisi aleyhine dava açıldığı ya da talep ileri sürüldüğü takdirde, bunun sonucunda herhangi bir hukuki ya da cezai sorumlulukla karşılaştığı takdirde, münhasıran kendisinin sorumlu olacağını ve Extreme Rent A Car’a karşı hiçbir talep ileri sürmeyeceğini kabul ve taahhüt eder.
Zabıt altına alınmamış hasarlarda, sürücü beyanı ile hasar onarım işlemi kesinlikle yapılmamaktadır.
(5) Kazanın, araç sözleşmesinde ismi yazan kişilerden biri tarafından kullanılırken gerçekleşmiş olması, kullanımı sırasında kesinlikle alkol alınmamış ve/veya uyuşturucu etkisi altında olunmaması, tek taraflı olarak kazaya uğraması veya çalınması durumunda, aracın yeri değiştirilmeden en yakın polis veya jandarma karakoluna başvurarak kaza, hırsızlık ve alkol tespiti raporları alınmış olması, Maddi Hasarlı Kaza Tespit Tutanağını tutanak üzerinde belirtilen şekilde doldurulmuş olması gerekmektedir.
Sürücü belgesiz araç kullanılıyorsa, Sürücüde yaş küçüklüğü varsa, Sürücüde alkol veya akıl sağlığı şüphesi varsa, Kazaya karışan araçlardan birinin kamu kurumlarına ait olması durumunda, Kamu kurumlarına ait eşyada zarar meydana gelirse, Trafik Kazasında sadece 3.kişilere ait eşyalara zarar gelirse, Kazaya karışan araçlardan birinin trafik sigortasının bulunmaması durumunda, Trafik kazası ölüm ve / veya bedeni zarar ile sonuçlanmışsa tespit tutanağı, trafik polisi tarafından düzenlenmiş olmalıdır.
(6) ÇALINMA durumunda, en yakın polis veya jandarma karakolu tarafından “Hırsızlık Tespit Raporu” alınmış ve anahtar ve araç ruhsatının Extreme Rent A Car’a teslim edilmiş olması gerekmektedir.
(7) Sigorta teminat limitlerinin üzerinde kalan her türlü hasar sorumluluğu kullanıcılarımıza aittir. Sigortalar hakkında daha detaylı bilgiyi kiralama yaptığınız ofisten alabilirsiniz.
(8) Lastik patlamaları, far, cam kırılmaları, stepne çalınmaları sigorta Kapsamı dışındadır. Sigorta fonunun ödenmemesi ve kiralanan aracın çalınması durumunda kiracı, Araç 45 gün içinde bulunursa motosikletin bulunduğu tarihe kadar olan kira bedelini, araç bulunmazsa o günkü 0 kilometre satış bedelini ödemekle sorumludur. Kiracı dışında araç ikinci bir şahsın kullanabilmesi; ancak geçerli kimlik ve ehliyetin sözleşmeye kaydı ile mümkündür. Aksi takdirde sigorta geçersiz sayılır ve motosikleti kiralayan tüm hasardan sorumlu tutulur.
Teslim ve İade
(1) Kiracı, kiralanacak aracın Extreme Rent A Car tarafından teslim edilmesi ve iade alınması sırasında Extreme Rent A Car merkezinde hazır bulunacaktır. Araç ya da Araçlar kontrol edilip Kiracı tarafından teslim alınacak ve kullanım süresinin bitiminde aynı yerde Extreme Rent A Car’a iade edilecektir. Kiracı, tutanaklarda belirtilecek Araç ya da Araçları teslim alma tarihi itibarıyla sağlam ve çalışır vaziyette teslim aldığını kabul ve beyan eder. Kiracı, Aracı ya da Araçları kira süresi sonunda tüm malzemeleri ile birlikte tam olarak, eksiksiz, hasarsız, sağlam ve çalışır vaziyette Extreme Rent A Cara iade etmekle yükümlüdür.
(2) Kira Süresi, tutanaklarda belirtilecek Araç ya da Araçları iade etme tarihi itibarıyla sona erecektir.
(3) Kiracı, Kira Süresinin uzatılmasını talep ettiği takdirde, Kira Süresinin bitiminden en az 24 saat önce Extreme Rent A Car’a bildirimde bulunarak talebini iletmekle yükümlüdür. Extreme Rent A Car, Sözleşme’yi uzatıp uzatmama konusunda takdir hakkını saklı tutmaktadır.
RENTAL CAR CONTRACT
Subject and Duration of the Contract
1. The contract has been concluded for the renting and use of the Atv, Utv, Motorcycle, Bicycle, which is owned by Extreme Rent A Car, to the “renter” within the framework of the conditions stipulated in the contract. The contract is valid for …….. days from the signing of the contract, and at the end of this period, it will automatically terminate without the need for any notice. The contract can be renewed by the parties only in writing.
Obligations of the Renter
(1) The “renter” undertakes that he will not allow anyone to use the ATVs, UTVs, Motorcycles, Bicycles he has rented under the Contract, except himself and the people whose name he has dictated. Otherwise, the “renter” will be compensated for the damage and loss by the “renter”.
(2) ATVs, UTVs, Motorcycles, Bicycles cannot be used for training, racing, off-road, rally and similar purposes other than their normal use. Otherwise, the “renter” will be liable to cover all damages and losses that may occur due to this reason.
(3) The “renter” is responsible for all damages that may occur as a result of using the vehicle outside its capacity and production purpose, hitting places different from the road level such as bumps and potholes, using it on the land and on the beach, and damages caused by water entering the engine or other parts of the vehicle.
(4) Vehicles cannot be overloaded or transported. Otherwise, the “renter” will cover all damages and losses that may occur due to this reason.
(5) Provided that all necessary precautions are taken, such as wearing a helmet, not loading loads and attachments that will disturb the balance of the vehicles, and avoiding the use of alcohol by the drivers during all periods of use of ATVs, UTVs, Motorcycles, and Bicycles. The safety of life and property of the person(s) in the vehicle will be protected. In addition, by paying maximum attention to traffic rules, any behaviour that may harm the safety of life and property of third parties should be avoided. If the renter causes damage or loss to the life or property of other persons in the vehicle, he will be solely responsible for covering all kinds of damages and losses that may arise due to this. For this reason, in the event that Extreme Rent A Car undertakes any damage or has to make a payment, Extreme Rent A Car will recourse to the “renter” for the compensation of the said loss.
(6) All of the traffic fines or accrued road tolls related to the vehicles during the period the contract is in force shall be paid by the “renter” within the legal period. Even if the relevant payment documents are notified to Extreme Rent A Car after the end of the Rental Agreement, the Renter will be solely responsible for these payments. For this reason, Extreme Rent A Car will recourse to the Renter in case of any penalty, expense or loss arising from the use of the Renter or if any other payment has to be made by Extreme Rent A Car.
(7) The “renter” must keep the vehicle locked whenever it is not in use.
(8) The “renter” must ensure that the correct and appropriate fuel is used.
(9) The “renter” must keep the tires and air at the required level.
(10) The “renter” may not sell, lease or dispose of the vehicles and any of their parts.
(11) The “renter” cannot give any person legal rights on the vehicle and cannot transfer his own rights. In case of emergency, the telephone number that you can reach 24 hours a day will be given to you by the office representative from whom you received the vehicle.
(12) Extreme Rent A Car will not accept responsibility for personal belongings forgotten in the vehicles.
Financial Provisions
(1) The Rental Price will be determined by taking into account the leased vehicles in each report.
(2) If the Renter does not return the vehicle or vehicles within 24 hours at the latest after the end of the Rental Period, Extreme Rent A Car will pay one time of the daily rental price for each delayed day as a delay penalty.
(3) Extreme Rent A Car will not be liable for any damages or claims, except for the responsibilities outside the scope of the compulsory financial liability insurance coverage.
(4)The “renter” undertakes to pay the repair cost of the damages that will occur due to user error, which are not covered by the insurance, and the fees for the days when we cannot rent the vehicle due to the damages not covered by the insurance. (Standard daily rental price will be charged over the price.)
(5)The “renter” undertakes to pay the damages that may arise due to the detention of the vehicle by the Police forces for any reason and the fees for the days we cannot rent the vehicle.
(6) The “renter” is responsible for the fees that may arise for delivering and receiving the vehicle or vehicles outside the city limits where our office is located.
Insurance Provisions
(1) Any kind of loss that may arise for any reason after the vehicle is delivered to the Renter shall be borne exclusively by the “renter”. In the event that the damage and losses arising from the “renter’s” own usage errors cannot be documented or the damage and losses are out of the scope of the insurance coverage for any reason, the “renter” shall immediately pay Extreme Rent A Car all kinds of expenses that will be necessary to compensate for the said damage and losses, without the need for a judgment in this regard. accepts and undertakes to pay.
(2) The “renter” cannot leave the vehicles parked or temporarily in unsafe places such as open parking lots, roads or pavement during the Rental Period. The “renter” is obliged to take the maximum security measures and to keep the Vehicle in a closed and secure parking lot while the vehicle is parked. Otherwise, the “renter” undertakes to pay all kinds of damages exclusively if the damages and losses that may occur in the Vehicle for any reason are not covered by the insurance coverage.
(3) If the vehicle is involved in an accident in any way, the “renter” promises to give the documents such as “alcohol examination report, accident report, photocopy of driver’s license, photocopy of the license of the other party, photocopy of the traffic insurance policy of the other party” to Extreme Rent A Car within seven days from the date of the accident. Whether it is the “renter’s” fault or not, in case of failure to collect from the insurance company or any other damage due to delays that may arise in this regard, the uncollectible amount or loss shall be borne exclusively by the “renter”.
(4) The “renter” shall be solely responsible for meeting any claim that may be brought forward by third parties in cases where the vehicle is involved in an accident that exceeds the coverage of the compulsory financial liability insurance policy or is out of the scope of such. In the event that a lawsuit or claim is filed against Extreme Rent A Car by the third parties caused by the accident, the “renter” accepts and undertakes to pay to Extreme Rent A Car even if this situation has not been notified, within one week at the latest from the date of notification of the court decision or payment document.
In case of undeclared damages, the damage repair process is definitely not carried out with the driver’s statement.
(5) In case the accident occurred while the vehicle was being driven by one of the persons whose name is written in the contract, the vehicle was never consumed with alcohol and/or under the influence of drugs, in case of accident or theft unilaterally; Before the vehicle is relocated, it is necessary to apply to the nearest police or gendarmerie station and get accident, theft and alcohol detection reports, and fill in the Material Damage Accident Detection Report as specified on the report.
If a vehicle is used without a driver’s license, if the driver is under the driving license age, if the driver has alcohol or mental health suspicion, if one of the vehicles involved in the accident belongs to public institutions, if damage occurs to the goods belonging to public institutions, if only the belongings of third parties are damaged in the traffic accident, from the vehicles involved in the accident, if someone does not have traffic insurance, if the traffic accident resulted in death and/or bodily harm, the report must be drawn up by the traffic police.
(6) In the case of THEFT, a “Theft Detection Report” must be obtained from the nearest police or gendarmerie station and the key and vehicle license must be delivered to Extreme Rent A Car.
(7) Responsibility for any damage exceeding the insurance coverage limits belongs to our users. You can get more detailed information about insurance from the office where you rent.
(8) Tire bursts, headlights, glass breakage, spare tire theft are not covered by the insurance. In case the insurance fund is not paid and the rented vehicle is stolen, the “renter” is responsible for paying the rental price up to the date the motorcycle is found if the vehicle is found within 45 days, and the 0-kilometre sales price of that day if the vehicle is not found. The ability to use the vehicle by a second person other than the “renter”; is only possible with the registration of a valid identity and driver’s license to the contract. Otherwise, the insurance will be void and the renter will be held responsible for all damage.
Delivery and Returns
(1) The “renter” must be present at the Extreme Rent A Car centre during the delivery and return of the vehicle to be rented by Extreme Rent A Car. The vehicle or vehicles will be checked, received by the Renter and returned to Extreme Rent A Car at the end of the usage period. The “renter” accepts and declares that he has received the Vehicle or Vehicles to be specified in the minutes, as of the date of receipt, in a sound and working condition. The “renter” is obliged to return the Vehicle or Vehicles to Extreme Rent A Car in full, complete, undamaged, sound and working condition with all materials at the end of the rental period.
(2) The Rental Period will expire as of the date of returning the Vehicle or Vehicles to be specified in the minutes.
(3) If the “renter” requests an extension of the Rental Period, he is obliged to notify Extreme Rent A Car at least 24 hours before the end of the Rental Period and convey his request. Extreme Rent A Car reserves the right to extend the Contract or not.
